I should've fit more Tom in there. I've got more on the way, though.

Thanks! this made me VERY happy....

I must say it's one of my favorite post combinations so far.
(Anonymous) on November 4th, 2009 07:39 am (UTC)
So you own the copyright on all these images then? Took the photos yeah? Is that why we can't alter them?
Bethany: blixa: human behavior[info]xhellsfirex on November 4th, 2009 07:48 am (UTC)
I'd rather you not alter and credit them to me because I don't want my name on ugly amateur edits I had no part in.

Post logged in next time. Unlike your resourceful self, I don't have time or energy to invest in spamming strangers. Don't worry your anon little head: when I'm being idle and lazy I have to at least do something productive like defile copyright laws with my non-profit Photoshopping.
(Anonymous) on November 4th, 2009 08:25 am (UTC)
I don't want my name on ugly amateur edits I had no part in.

The copyright owners might feel the same way!

Seriously though - if someone does alter them, what exactly are you going to do about it?
HF Icons[info]hficons on November 4th, 2009 01:15 pm (UTC)
God. Normally you would hear crickets but they were uncomfortable about just how redundant that was.
(Anonymous) on November 4th, 2009 10:09 pm (UTC)
Good comeback! Still wondering what horrific punishment I might expect if I dare alter these amazing icons.
HF Icons[info]hficons on November 4th, 2009 11:23 pm (UTC)
Let me backtrack for you, since the redundancy conundrum implying that the answer to your question and any others you may have had concerning credit irony and my icons was to be found in my first comment went vroom over your head. That whole bit happened when I wrote: “defile copyright laws with my non-profit Photoshopping”, but don't worry on grasping the ironic syntax and all that jazzy jargon now. Take my hand and we'll go through it together. Baby steps, Anon, baby steps.

    i. "The copyright owners might feel the same way!" It is a fundamentally different situation, my pet. The photographers are not being credited with any of the edits I've made here, so they are not being pegged with "ugly amateur edits". This is merely free press for them, if anything.

    2. Everyone (except Joes and Janes like yourself) apparently understands LJ icon etiquette and takes it as a given that I claim no hold to the original photos (or they bothered themselves and read my profile where I actually say so in really big letters!).

    3. This is not a violation of copyright. This is the equivalent of printing out the pictures, doodling on them in crayon, and placing them on my friends' fridges. There is no lawsuit here because there is no exchange taking place.

    4. Finally, I'm not going to enforce any "rules" because I don't care. All I can do is ask for decent behavior.
Let's refer back to the crayon scenario, to stick to understandable terms, shall we, Anon? I'm responsible for the particular aesthetic outcome of the crayons on these printed pictures, and so I can sign my name on the corner in the black crayon if I want to and ask other people to recognize that it was my hand that moved the crayon. If they smudge it out and write theirs in the red crayon over it, or leave my name but do something really ugly over my pretty squigglies, that's pretty uncool, but I'm not going to bother with "horrific punishment". Why? Because it's a crayon doodle.

Buzzy, buzz, buzz... That's the sound of all the bees in your bonnet. I hope I've put your troubles enough at rest to go and find some other way to amuse yourself other than caring enough to find your noisy, buzzing way back to my post while logged out just to check if I've replied to your bored antagonizing. Don't get me wrong, though, it's still such a pretty sound, and least I can direct the next numbered beekeeper Satan spawns from his filthy loins to this series of comments. You are certainly not the first to think themselves telling me something new on this topic, and shall certainly not be the last.
(Anonymous) on November 4th, 2009 11:31 pm (UTC)
Yeah, I don't care about any of that. Just wondering how you were going to enforce your "rules".

From what I picked up while skimming over that rant though:

4. Finally, I'm not going to enforce any "rules" because I don't care.

So... if you don't care, why are the rules there in the first place? I'm sure you'll have some smartarse comeback, but that's what it comes down to - you state rules that you are going to in no way attempt to enforce, and by your own admission, don't even care about. Why bother?

By the way: read my profile where I actually say so in really big letters!).

I haven't seen your profile - I came here through a cut on a community - in my first comment I thought I was commenting on the community. I don't care about you, I've just always found this "Wahhhh don't change my icons" thing odd. And amusing.
HF Icons[info]hficons on November 4th, 2009 11:56 pm (UTC)
Yeah, you get what you give. I don't care about clarifying my point by repeating it word for word to answer your question either. What's left to do when water doesn't solve your drought?

Thanks for being a grade A cock-hole, by the way, and sharing your golden curiosity with the rest of the class. Come back logged in if you've got anymore droplets of wonder to splash my post with. You know what Hemingway said about critics? They're people who sit and watch a battle from a high place and come down to shoot the survivors. Yeah. I'll be waiting here working hard doing something or other creative while you get another shower ready for me.

i have recent experience in this and in my case i will tell you the photographer reacted very badly when the photos were changed without permission. i saw the persons photos in a big newspaper and emediatley i knew this wasn't the photgraphers photoshop edits. but all the other wiewers didn't know, and they might believe it was the photographers choice to make obvious and stupid photoshop edits.

i'm just saying: not all people veiw it as free press, some people don't like it.

"
3. This is not a violation of copyright.
"

i always thought it was a violation... but that may just be the fact that different countries has different rules..

i accept your rules but i don't like them. thats why i never use other peoples pictures in my icons.

anyway. i really like 6 and 21
and i don't mean to offend you in any way. i edited cause of too many spelling errors.
Bethany[info]xhellsfirex on November 11th, 2009 11:44 pm (UTC)
No, that I do agree with. If it's being printed in a newspaper with edits the photographer didn't sanction then that is an infringement. Using icons on LJ though is not any type of formal or profitable usage. But still, if any photographers contacted me and asked me to take something down I would graciously do so, no questions.

Thank you, and I respect and understand where you're coming from.
-[info]annalotta on November 11th, 2009 11:53 pm (UTC)
i understand your position also. i am glad that you respect the photgrapher.

it is a difficult question..
where do you draw the line? in some ways, som spaces on the internet are just like the papers, but some places are free and made by ordinary people..
when is it free to post a picture and when is it not? i cannot answer thsi question so my personal rule is to never make pictures of someone elses photos. just like i donn't lie to take credit if someone helps me with a cardgame or a crossword puzzle... i guess it's more of a "this is just my own thing"- pride kind of situatipn sometime... and that's weird in it's own way....
Bethany: nick: ah'm bleedin'![info]xhellsfirex on November 12th, 2009 12:05 am (UTC)
In the situation with the newspaper, they are printing both a product and a source of information. This is a double "no" in my mind. They are receiving money from printing the photographer's work without their permission and they are not providing accurate information.

I think it becomes an issue as soon as any type of exchange comes in to play. If I am receiving something for it, it is a legal issue. With LJ icons, it's non-profit, non-exchange recreation, so I don't see any harm in it. As I said though, if a photographer contacted me with issues, I would respect any wishes to remove things (even though I know there is no legal ground here :P).

I have been commissioned to do web layouts and album artwork before, and in these situations I will never use the work of others without legal sanction and permission. (and even in the cases where I get permission it's just things like fonts, or photography that the commissioner owned and wanted used in the work)
